Binly Rental Agreement
This Rental Agreement (“Agreement”) is entered into between the undersigned customer (“Customer”) and Binly LLC (“Binly”) for the rental of certain moving supplies and equipment.
Definitions
Equipment refers to all items provided by Binly for rental, including but not limited to plastic moving boxes (“Boxes”) and dollies (“Dollies”).
Customer refers to the individual or entity who is renting equipment from Binly and is responsible for its use, care, and return.
Terms of Use
1. Equipment Responsibility
Customer acknowledges having care, custody, and control of the Equipment while it is at the Customer’s location. Customer accepts full responsibility for any loss or damage. If Boxes or Dollies are lost, stolen, or damaged while in the Customer’s possession, the Customer agrees to pay the full retail replacement value:
$25.00 per Box
$75.00 per Dolly
Customer agrees not to alter, deface, permanently mark, sublease, rent, or sell the Equipment. Equipment shall remain the property of Binly and shall not be used for any unlawful purpose or in any manner that causes damage or excessive wear.
2. Cleaning Fee
Customer is responsible for returning Equipment clean and free of stickers, residue, hair, liquid, or soil. If returned in unsanitary condition, a $50.00 cleaning fee will apply.
3. Delivery & Pick-Up Scheduling
Binly will deliver and pick up all Equipment at the address provided by the Customer. The Customer is responsible for ensuring someone is present at the scheduled delivery and pick-up times.
If no one is available at the scheduled delivery or pick-up time, a $50.00 re-delivery fee may be charged.
If the Customer needs to reschedule, at least 48 hours’ notice must be provided. Rescheduling within 48 hours of the scheduled time may incur a $50.00 rescheduling fee.
Any changes to delivery or pick-up details (e.g., address, access instructions) must also be communicated with at least 48 hours’ notice.
The Customer is responsible for ensuring the delivery location is accessible, safe, and free of obstacles or hazards that could prevent successful drop-off or pick-up.
4. Rental Duration & Late Returns
Customer agrees to return all Equipment by the agreed-upon date.
For each additional week the Boxes are not returned, the Customer will be charged the standard weekly rental fee based on their selected package as listed on Binly’s website or pricing sheet.
If Boxes are not returned within 30 days, and no communication to extend the rental has been received, the Boxes will be considered purchased and the Customer will be charged $25.00 per Box.
For Dollies, late returns incur a $10.00 per Dolly per week fee. Unreturned Dollies after 30 days without communication will be charged at $75.00 per Dolly.
Partial weeks are not prorated; late fees are applied as full weekly charges.
5. Payment Authorization
Customer authorizes Binly to keep a valid credit card on file for the duration of the rental and authorizes Binly to charge that card for:
Rental fees
Cleaning or re-delivery fees
Late return or replacement costs
Any other charges incurred under this Agreement
6. Access for Delivery and Pick-Up
Customer grants Binly and its representatives permission to access the property at the delivery and pick-up address to drop off or retrieve Equipment at scheduled times. Equipment may only be released to a verified Binly employee or partner.
7. Indemnification
Customer agrees to indemnify, defend, and hold harmless Binly, its officers, agents, and employees from any claims, damages, losses, liabilities, or expenses (including reasonable attorney’s fees) arising from:
Use or misuse of the Equipment
Injury or property damage related to the Equipment
Any legal actions connected directly or indirectly to this rental
Customer acknowledges they are solely responsible for the safe operation of the Equipment while in their possession.
8. Warranty
Binly warrants that the Equipment will be in good working order at the start of the rental. If Equipment is found to be defective upon delivery, Binly’s sole obligation is to repair or replace it.
9. Cancellations & Refunds
Cancellations made more than 48 hours before scheduled delivery are eligible for a full refund.
Cancellations made within 48 hours of delivery are subject to a $50 cancellation fee.
10. Force Majeure
Binly is not liable for delays or failure to perform due to events beyond its reasonable control, including but not limited to natural disasters, transportation interruptions, equipment shortages, or labor disputes.
11. Governing Law & Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of Oklahoma. Any disputes arising from this Agreement shall be resolved in the courts located in Tulsa County, Oklahoma.
12. Modifications
Binly reserves the right to modify this Agreement at any time. All previously signed agreements will be honored as written at the time of signing.
